Received garnishment for one of my employees.
This employee is super part time only about 10 hours per week, and she makes her own hours. I hired her on w4 but I don’t believe she participates in our 401k or anything like that, and I know she could technically be classified as a 1099 contractor. I have already done my part in the garnishment process, and I’ll have to start withholding wages next pay period, however it just dawned on me that maybe I should offer to reclassify her. I know that creditors can not garnish payments to independent contractors, so I’m considering offering that to her as an option. If that’s what we decide to do, then how should I go about notifying the court and the plaintiff? Do I send a notice of resignation or something? I’d ideally just have her put in a formal resignation and then immediately sign her back on as a 1099…

Tax Benefits: Independent Contractor vs Forming a Business
Hey all! So long story short, I’m a comedian who will make income for the first time in 2022 in the form of royalties from a comedy special and album. I produced the project myself, so I have expenses. Is there a tax benefit to forming a business (LCC, Sole Proprietorship, S/C Corp?) as opposed to just going the independent contractor route and writing off expenses on a schedule c? Some more info: I plan to put out more specials/albums in the future. Plus, hoping the exposure will help sell tickets for road work. So more income could come from ticket sales as well as royalties. There’s also a possibility of monetizing a related youtube channel. So would it makes sense if all of this was under the umbrella of one business? Thanks!
